Teenagers

Seniors

Auto insurance premiums are generally higher for drivers 75 years old and above. The gradual increase in rate begins at age 55. This is due to decreased reflexes and vision, as well as other health conditions brought about by, or that worsen with, advanced age. However, there are some associations for the retired and supplemental driving classes that allow for auto insurance discounts. A good driving record in previous years will also be taken into consideration.

Bedava: Fatal Los Angeles Car Crash Results in Arrest of Female Motorist

A crash that occurred at Figueroa Street and Avenue 51 resulted in the death of a 51 year old woman, Maria Luisa Dominguez and a 6 year old girl who was riding in her van.  Dominguez died at the scene of the accident, and the young girl was pronounced dead after arriving at the hospital.

The accident occurred when a woman in a pickup truck crossed into the opposite lane, striking the Dominguez van, according to Los Angeles Police. The driver of the pickup may be charged with murder, and was arrested on suspicion that she may have been driving under the influence of narcotics.  Two people were in the pickup with the woman, and four in the van.  There is no word available about the other occupants involved.

People often assume that driving under the influence involves alcohol, but it often means something else.  Every year, hundreds of car accidents in California are caused by people driving while using illegal and prescription drugs.  Prescription pain killers often cause side effects and can impair a person’s ability to use good judgment while driving a car or any other heavy machinery.

Fatal Pedestrian Accident at UC Berkeley Results in Wrongful Death Lawsuit

Earlier this year a five-year old boy was killed in a pedestrian accident that involved a truck after he was dropped off by his school bus to attend an after school program. The boy, along with some of his friends, usually attended the after school program at UC Berkeley every school day. The bus driver usually dropped off the children at a safe location from where they walked to their after school program at the Clark Kerr Campus of UC Berkeley. On this fateful day, however, the bus driver, for one reason or another, did not drop off the children in the same location. After being dropped off by the bus, the little boy was walking to his after school program when he was hit by a truck. His parents are now filing a wrongful death lawsuit against the driver of the truck, who was not cited following the accident, along with the driver of the bus, the school district, the trucking company, and regents from the University of California. An employee from the after school program is also being filed against, likely because they were not available to ensure the boy’s safe passage to the after school program.

Any one of these individuals, or a combination of these individuals and entities, may be held liable for the death of this little boy. As a five-year old, he should have had access to extra protection and care as he traveled from his elementary school to his after school program. Because he didn’t have that specialized care on the day of the accident, he was killed. Wrongful death claims can be filed in California only be relatives of the victim. Although many people might be outraged by the death of this child, only his parents or other relatives are legally able to file a wrongful death lawsuit against those they believe to be responsible for his death. Six Injured During MUNI Streetcar Accident in San Francisco

Just last week another MUNI accident occurred, this time involving an SUV. Six people were injured from both the MUNI streetcar and the SUV when the streetcar slammed into the back of the other vehicle. The impact was so strong that the SUV was actually pushed into the back of another MUNI streetcar that was stopped for the traffic up ahead. Witnesses inside the MUNI streetcar say that their driver was distracted before the crash because he was speaking to one of the passengers. He was unable to stop in time to avoid hitting the SUV, which was a Nissan Pathfinder. The Pathfinder sustained serious damage to both the front and rear, but the middle section of the vehicle seems to have remained intact. The driver of the Pathfinder was taken to the hospital where he received treatment for minor injuries. The driver of the MUNI car which hit the SUV from behind was also taken to the hospital and there receive medical treatment for minor injuries as well.

On impact, several people were thrown to the floor in the MUNI streetcar that hit the Nissan Pathfinder. Passengers in the MUNI streetcar ahead of the SUV were also likely thrown from their seats and onto the floor, which could have caused serious injuries to fragile persons onboard. This accident occurred only weeks following another accident involving a MUNI streetcar. In the first accident, the driver reported to police that he blacked out just before he crashed the vehicle. The chief of MUNI streetcars has shared his regret for the accident and promised that actions will be taken in the near future to make MUNI’s safer for frequent passengers.

This is not the first time this year that there have been accidents in the world of public transportation. In fact, a number of different accidents in public transportation have resulted in injuries and deaths throughout the United States this year. Three Injured in Lassen County Multi-Vehicle Accident

At the beginning of the month a multi-vehicle accident occurred in Lassen County when a drunk driver hit an oncoming truck in a head-on collision. The drunk driver was in an SUV when he failed to see that a pickup truck was driving in the lane next to him going the opposite direction. The 55-year old drunk driver of the SUV swerved into the wrong lane and hit the truck head-on. The truck was being driven by a 93-year old woman.

Unable to gain control of the truck after being hit, the woman driving the truck spun across several lanes of traffic and hit an oncoming van. The van was being driven by a 74-year old Ravendale resident. Apparently the truck was carrying a 55-gallon drum of scrap metal which flew out of the truck bed and landed onto yet another vehicle being driven by a man from Susanville. The truck being with the 93-year old woman finally came to a stop when it got stuck in a large pile of rocks. Because of the angle at which the truck hit the van, the 77-year old woman driving the van was actually trapped inside for a time until police and rescuers could extract her from the vehicle. Thankfully no one was killed in this horrific accident, but three of those who were involved were injured. Car Accidents Kills Boy from Thousand Oaks Near Los Angeles

It was only two weeks ago that an 11-year old boy was killed in an automobile accident involving a driver who was under the influence of prescription drugs in Thousand Oaks, Near Los Angeles. The boy was sitting in the backseat of an SUV that was being driven by his aunt. The boy’s aunt was apparently under the influence of prescription drugs she had taken earlier that morning. She pulled to a stop at a stop sign in an intersection, but did not pay attention to an oncoming pickup truck that had the right of way. The aunt pulled out in front of the oncoming vehicle. The driver of the pickup truck was unable to stop and the SUV with the woman and her little nephew in the backseat. The boy incurred severe injuries and was quickly airlifted to a hospital nearby.

The accident happened on the Fourth of July, and it wouldn’t be surprising if the boy and his aunt were on their way to the store to buy fireworks and celebrate the birthday of our country. Because his aunt was under the influence of prescription drugs, however, the little boy never got to celebrate the national holiday. After being taken to a hospital nearby, the boy was reportedly moved to the Children’s Hospital in Los Angeles where he died approximately 24 hours later of his injuries.  Unfortunately, someone should contact a Los Angeles wrongful death attorney to help in this case. There was another young boy in the pickup truck as well, but his injuries were thankfully minor. The driver of the pickup truck, as well as another passenger, was uninjured. Cell Phone Laws May Not Contribute to Lower Accident Rates, According to Study

A study conducted by The Highway Loss Data Institute reveals that new laws put in to place banning the use of cell phones and texting while driving don’t necessarily mean that accidents will decrease.  Recently, driving while distracted has been a huge topic in the news following several tragic accidents involving public transportation.

According to the Highway Loss Data Institute, which is sponsored by the insurance industry, the studies they performed showed little difference in accident rates in those states that had bans in place on cell phones and texting, and those that did not.  This group studied monthly car accident claims from 4 states that had bans in place, and compared them to data taken prior to the bans being placed, and after.  At one point, accident claims declined in New York but this seems to have happened before the ban on the use of handheld cell phones while behind the wheel.

California personal injury lawyers are not surprised by these results, and for good reason.  While the Highway Loss Data Institute did research in 4 states, no in-depth research has been conducted to determine how much texting and cell phone use has decreased since bans were put into place in some states.  For example, cell phone use was said to have dropped between 45 and 70 percent in California after bans were put into place, and these numbers may have been correct at the point that the survey was conducted.  However, most people are careful to follow new laws when they are first enacted, then return to old behaviors once they see that those laws are not being enforced.  While there may have been a significant reduction in the use of cell phones in California at the time of the study, it is probable that as the newness wore off and strict enforcement waned, motorists began to feel safe about talking on their cell phones again while driving.

It should also be said that insurance claims are not filed in every single accident that takes place.  For example, if an accident occurs that results in very little to no car damage and no one is injured, motorists may determine not to file a claim, so the Institute’s results may not be precise.

If banning use of cell phones or text messaging comes with secondary enforcement, this may be a reason that the laws don’t have as much impact.  When a motorist must be pulled over for a prior offense before being cited for texting while behind the wheel, the message doesn’t seem to sink in to drivers.  California auto accident lawyers realize that the penalties for cell phone violations are much too light to have the impact needed to stop this risky behavior.

As Holidays Approach, Americans Are Assured of Toy Safety by CPSC Chairwoman

Parents around the world are prepared to start shopping for the gifts their little ones want as the 2009 Christmas holiday approaches.  Concerns over the safety of many toys and gifts that children want are a top priority, as so many stories of phthalate contamination and lead content make headlines.

Should parents be concerned, and to what extent?

According to Inez Tenenbaum, chairwoman of the Consumer Product Safety Commission, parents should not be at all concerned.  Recalls have declined in 2009 compared to 2007 and 2008, and this can be attributed to the higher standards set by new safety laws.  The minimum amount of lead content that is determined to be safe has been reduced due to an act that was passed by Congress last year, the Consumer Product Safety Improvement Act.

Toys, clothing accessories and other child gear are a few in the wide range of children’s products that new laws apply to.  The CPSC financial resources were increased, and stricter standards for testing and documentation set under a law which was signed on August 14th 2009.  These new laws require manufacturer’s to meet the updated safety standards or risk paying penalties or even doing jail time.  This applies to manufacturer’s of toys, clothes, electronics, video games, bedding and books among other items.

The CPSC budget was raised to $136 million, and by the year 2013 staff is to be increased by 500 people.  By August of 2011, the amount of lead content in children’s products is allowed to be 100 PPM, compared to 300 PPM in August of this year.

Additionally, the manufacturing, distributing or importing of children’s products that contain a higher than .1% level of phthalates has also been made illegal by the CPSC, and employees are protected when they see violations that are being committed by their employer and report them to authorities.

According to representatives of the consumer safety group WATCH, in 2009 there were 31 recalls that resulted in more than 4 1/2 million toys being taken off the market.  In 2007, millions of toys that were manufactured in China had to be recalled due to high lead content, and Tenenbaum says that the Chinese have been much more concerned about the safety of children’s toys since that time.  Los Angeles lawyers are interested in seeing how the Chinese improve the safety and quality of the products they manufacture, following the poor performance of the past two years.

Tenenbaum feels that parents can shop with confidence and the knowledge that improved laws are in place to protect their children.  She does caution parents to use common sense and good judgment when shopping for toys, and to buy products that are age appropriate.  For example, toys that contain many small parts and could cause choking in young children should be avoided.

San Diego Restaurant Customer Killed as SUV Plows Through Building

A 74 year old El Cajon resident plowed through the Carl’s Jr. restaurant recently, killing a 66 year old many who sat in a front booth of the restaurant eating his breakfast, as was his daily routine.  According to Signs of San Diego, the Honda CRV crashed through the building, hitting the victim with full force which threw him sailing to the other side.  The SUV plowed through the corner of the restaurant without stopping after hitting the victim.  When it eventually did stop, the driver, who left a trail of smashed glass and wood in his wake, was taken to a hospital for moderate injuries.

It is believed that the driver had just used a Union Bank ATM that was located in the same shopping center as the restaurant.  He drove approximately 150 yards across the lot before crashing into the restaurant, and there is no information as to the speed of the vehicle at the time of the crash.  Police and investigators are also unsure as to whether the man attempted to slam on the brakes before crashing in to the building.  There are also concerns about the structural integrity of the building, which received substantial damage in the crash.

Investigations will focus on whether drugs or alcohol were a factor in the crash, and determining the speed of the SUV.  At the time of the accident, there were no indications that drugs or alcohol were involved.  Another victim at the scene stated that he was behind the SUV at the ATM, and that the driver of the SUV seemed to have trouble with the ATM machine, which resulted in him leaving in anger.  He forgot to take his ATM card which the witness says was left in the slot.  Additionally, the witness states that the SUV driver almost backed up into the witness’s car before tearing through the parking lot and slamming through the restaurant.

Details are still sketchy, and the driver may be able to provide information as to what caused the crash.  It could have been a medical emergency while he was at the wheel, but everything to this point is simply speculation.  Investigators will work to determine exactly what did cause the fatal crash.

The question as to whether the roads are safe when senior citizens get behind the wheel is one that raises many issues.  California personal injury lawyers know that the issue is a sticky one that causes much debate, but seniors will argue that they are safer and involved in fewer accidents than teens.
